日本国憲法（前文）を訳そう 第3回

さて前回は、憲法が政府について定めている部分についてだった。今回は、日本人の平和に対する考え方が述べられており、平和の維持と圧制の排除に努めた結果、国際的な評価を得たいという希望についても触れられている。

We, the Japanese people, desire peace for all time and are deeply conscious of the high ideals controlling human relationship, and we have determined to preserve our security and existence, trusting in the justice and faith of the peace-loving peoples of the world. We desire to occupy an honored place in an international society striving for the preservation of peace, and the banishment of tyranny and slavery, oppression and intolerance for all time from the earth. We recognize that all peoples of the world have the right to live in the peace, free from fear and want.

わたしたち日本人はいつでも平和を心から願い、どうやったら人と人、国と国との関係をうまく調整できるか、ということについてよく考えている。また、世界の平和を愛するひとびとがもつ正義と信念を信頼することによって、自分たちの安全と生存を維持しようと努めている。さらに、平和を維持することと、専制、奴隷制、圧制や偏狭な政治を世界からなくすよう努め続けることによって、国際社会で名誉ある地位を占めたいと強く望んでいる。加えて、全世界の人々が平和に暮らし、恐怖から自由であり、また、そうありたいと望む権利を持つことはごく自然なことであると考えている。

日本国憲法（前文）を訳そう 第2回

日本国憲法前文（英語版）を日本語に訳そうプロジェクトの第2回である。前回は、主権在民について、民主制について、それからその民主制に基づく平和への強い意志について述べられている部分だった。今回は、憲法が政府について定めている部分についておおまかに触れられている。

Government is a sacred trust of the people, the authority for which is derived from the people, the powers of which are exercised by the representatives of the people, and the benefits of which are enjoyed by the people. This is a universal principle of mankind upon which this Constitution is founded. We reject and revoke all constitutions, laws, ordinances, and rescripts in conflict herewith.

政府については次のように定める。まず、それはわたしたちの気高く、清らかな信頼に基づくものである。また、政府がものごとを動かす力は、国民というものがあればこそ、力として成り立つ。そして、その力はわたしたちの代表によってうまく運用され、政府によってもたらされる利益は全国民が享受する。この人類すべてに共通する価値観に基づいてこの憲法は、つくられている。この憲法とうまく噛み合わない憲法、法律、条令、勅令は認めないし、あったとすれば、廃止する。

語の訳し分けで難しかったのは、 the authority(the moral or legal right or ability to control)とthe powers(the amount of political control a person or group has in a country)の違いである。両方とも安易に「権力」にしてしまいそうだったが、それはやめて、とりあえず「権威」と「権力」を当てた。しかし、「権威」と「権力」の差異が一読してそれほど明確に理解できるとも思わないので、そのあと「ものごとを動かす力」とやや噛み砕いた語を当ててみた。どうだろうか。微妙なところではある。尚、上記二語の定義はCambridge Dictionaries Online(http://dictionary.cambridge.org/)に拠った。

日本国憲法（前文）を訳そう 第1回

作家の高橋源一郎が彼のコラム（http://www.mammo.tv/column/TakahashiG/bnumber.php）で、池澤夏樹の訳を例に挙げながら、日本国憲法を訳してみたら面白いんじゃないか、と提案していたので、不肖ながら挑戦してみる。ただし前文のみ。根本的な文法の間違いもあろうかと思うが、その際はぜひご指摘頂きたい。


念のために言っておく。高橋のコラムでは日本国憲法はGHQ（連合国軍総司令部）が英文で起草した、と紹介されているが、日本語版は翻訳版ではない。わたしの友人（法学部卒）によれば、「日本国憲法の「原典」は英語ではない。日本語である。それはGHQの草案を元に作られたものである。それ故、GHQ意向が強く反映されているとされる」そうだ。

では、参るぞ。まず最初の文！長いぜ！

We, the Japanese people, [acting through our duly elected representatives in the National Diet, determined that we shall secure for ourselves and our posterity the fruits of peaceful cooperation with all nations and the blessings of liberty throughout this land, and resolved that never again shall we be visited with the horrors of war through the action of government,] do proclaim that sovereign power resides with the people and do firmly establish this Constitution.

これで一文である。括弧をつけたactingからgovernmentまでは、この文の構造に直接的にかかわっているわけではない。重要なのは「We, the Japanese people, do proclaim that sovereign power resides with the people and do firmly establish this Constitution. 」という部分である、と思う。

まだまだ練り直す余地はあるだろうが、以下に原文、拙訳の順で置く。国の最高法規としての気品はないが、比較的わかりやすい訳になったと思う。いかがだろうか。

わたしたち日本人は、日本国では主権在民であることと、正式にこの憲法を定めることを、広く宣言する。その前提として、ふたつ決意したので付け加える。ひとつめの決意は、わたしたちが、きちんと選ばれた国会で活動する代表を通じて行動し、わたしたちとその子孫にたいし、以下の点にかんして保障することである。まず、世界中の国々との協力によって成り立つ平和がもたらす利益について、そして、この国の中であれば、好きなところへ行ったり住んだりできる自由について、である。ふたつめの決意は、政府の行動によって私たちに戦争の恐怖が二度と訪れないようにする、ということである。
